The V.I. Department of Licensing and Consumer Affairs has filed a civil lawsuit in Superior Court against eight pharmaceutical companies, alleging that failures to monitor suspicious opioid orders and misleading marketing contributed to opioid misuse and related harm in the territory.
The complaint names Alvogen, Amneal Pharmaceuticals, Apotex Corporation, Hikma Pharmaceuticals, Indivior, Mylan, Sun Pharmaceutical Industries and Zydus Pharmaceuticals. DLCA alleges that the companies maintained inadequate systems for identifying or stopping suspicious orders involving opioid products they manufactured or distributed.
The filing also makes company-specific allegations, including claims that Indivior promoted opioid-dependence medications too aggressively and that Mylan misrepresented the relative safety of fentanyl patches. These are allegations in a newly filed complaint, not findings by a court, and none of the eight defendants had filed a response when the case was reported.
DLCA is asking for an injunction against future unfair or deceptive practices as well as restitution and compensation for alleged harm. No hearing schedule, case number or claimed dollar amount was included in the public report.
DLCA should publish the filed complaint, case number, requested remedies and a dated case-status page, while clearly linking any future answers, rulings or settlement documents so the public can follow both sides of the litigation.
