The BVI House of Assembly passed the Electronic Transactions (Amendment) Bill, 2026, without amendment during its October 20 sitting, according to Virgin Islands News Online.
The House's published description says the bill would narrow exclusions in the 2021 Electronic Transactions Act to improve legal certainty and efficiency for cross-border business. The reported debate identified secured-financing documents and share transfers among the transactions affected by the current uncertainty.
Members also called for the benefits of electronic execution to reach local residents and businesses, including people on the sister islands who may otherwise need to travel to Tortola for signatures or documents.
House passage is a legislative milestone, not proof that the amendment has received the governor's assent, been gazetted or taken effect. Businesses should continue using current legal requirements until an official commencement notice is published.
The House and Cabinet Office should publish the final passed text, assent and gazette dates, commencement provision and a plain-language guide for local and cross-border users on one durable page.
