WAPA explains missed federal consent-decree reports

The authority cites calendaring and email failures after a judge demanded an explanation; possible sanctions remain unresolved.

WAPA attorneys told the federal judge overseeing the Randolph Harley power plant consent decree that missed monthly progress reports resulted from internal responsibility, calendaring and email-routing failures.

The reports track work on troubled Wartsila generators, FEMA-funded replacement generation and repairs to older units 15 and 23. WAPA filed overdue material and says it has added court deadlines to its internal litigation calendar even when outside counsel has primary filing responsibility.

U.S. District Judge Mark Kearney had asked why sanctions of up to $500 and a referral to disciplinary authorities should not follow the repeated missed deadlines. WAPA's filing is a response to that order, not a ruling that sanctions have been imposed or dismissed.

The overdue report also addresses WAPA's attempts to obtain an unredacted Wartsila analysis concerning four generators that have not operated on liquefied petroleum gas as intended.

SUGGESTED IMPROVEMENT

WAPA should publish each required progress report and a plain-language generator-status dashboard when filings are submitted to the court.
